EEOC Sues Healthcare Company for Refusing to Hire HIV Positive Man

The Pittsburgh Post-Gazette reported that the Equal Employment Opportunity Commission (EEOC) recently filed a lawsuit representing a man who was denied a job as a “sitter” with a medical staffing firm because of his HIV status. The Pittsburgh area resident, who is not named in court documents, applied for the job with Maxim Healthcare Services, Inc., two years ago. The lawsuit claims that, although the candidate was qualified for the position, Maxim told him “that he could not be hired and assigned to the [Veterans Affairs] facility because he was HIV-positive,' even though his doctor, who disclosed the man was HIV, wrote there was “no contraindication to working.” With the lawsuit, the EEOC is seeking damages for the man, as well as a court order to prevent Maxim, which is based in Maryland, from future hiring discrimination against persons who are HIV-positive.
